Defense Attorney Tip of the Week

As criminal defense attorneys at Intermountain Legal, we understand that getting pulled over for a DUI can be frightening. It’s important to remember that if you are pulled over, there are certain things that will benefit you, and there are certain things that will only worsen your situation.

What NOT To Do:

First, let’s talk about what won’t help you: coloring in the 3s on your license plate with permanent marker to make them look like 8’s. While this may seem like a clever idea, it’s not going to fool law enforcement. In fact, it could even result in more charges being brought against you. So, if you’re thinking of trying this, don’t!

What TO Do:

Now, let’s talk about what can help you build your case. If you are pulled over for a DUI, one of the most important things you can do is politely decline to take any field sobriety tests (FSTs). These tests include the “follow my pen with your eyes” test, the “walk the line” test, and the “one foot stand” test. Even sober people can fail these tests, so it’s in your best interest not to take them.

It’s important to remember that while you are required to take a breathalyzer or blood test if asked, you are not required to take FSTs. By declining these tests, you are not giving law enforcement any evidence that they can use against you in court.
